Intellectual Property

Intellectual property laws govern the rights to intangible (incorporeal) property.
They are also called intellectual property rights and often constitute a substantial (intangible) value for a company. Therefore, it is important (e.g. when it comes to own trademarks) to ensure that only the company has the exclusive right to the profits from its investments (into developing a trademark, copyrighted work, etc.).
If an existing right to a trademark is infringed, the rights holder is entitled to damages and injunction. Furthermore, the goal is to prevent imitations and counterfeits (exploiting the company’s reputation). In addition, it is highly relevant that intellectual property rights can be licensed for use by third parties (e.g. by licensing the exploitation of a copyrighted work).

Due to its technical complexity, grasping this subject can be challenging even for legal experts. It requires looking at the specific situation from different perspectives as well as legal and technical know-how in order to ensure optimal solutions. Our practice offers the perfect skill set in this area.
